1. Definitions

• "Diginet Academy," "we," "us," or "our" refers to the offline training institute located in Kochi, Kerala, operating under the domain diginetacademy.in.
• "Site" refers to the website located at diginetacademy.in.
• "User," "you," or "your" refers to any individual accessing the Site or enrolling in a course.
• "Course" refers to the offline training programs offered by Diginet Academy, including but not limited to Graphic Designing, Digital Marketing, and Full Stack Development, along with any associated online materials provided via our LMS.
• "LMS" refers to our online Learning Management System used to provide supplementary course materials, resources, or online class components.

2. Course Enrolment and Participation

2.1. Enrolment Process: To enroll in a Course, you must complete the registration process as outlined on the Site or by our admissions team, including providing accurate information and paying the required fees.

2.2. Offline Attendance: Our primary Courses are conducted offline at our institute in Kochi, Kerala. Regular attendance and active participation as per the course schedule are expected. Specific attendance policies may apply to individual courses.

2.3. Code of Conduct: You agree to abide by the rules and regulations of Diginet Academy while on institute premises, including respecting faculty, staff, fellow students, and institute property. Disruptive or inappropriate behavior may result in dismissal from the Course without a refund.

3. LMS Access and Accounts

3.1. Account Creation: Access to supplementary online materials via our LMS requires creating an account. You are responsible for maintaining the confidentiality of your account login credentials (username and password).

3.2. Responsibility: You are solely responsible for all activities that occur under your LMS account. Notify us immediately at support@diginetacademy.in if you suspect any unauthorized use of your account.

3.3. License Grant: Upon successful enrolment and payment, we grant you a non-exclusive, non-transferable, personal license to access and use the specific online Course materials made available to you via the LMS for your personal educational purposes only.

3.4. Restrictions: You agree not to transfer, resell, sublicense, or otherwise distribute your LMS access or any Course materials (online or offline). You may not copy, modify, reproduce, or create derivative works from the Course materials without our express written permission.

3.5. Access Duration: Access to LMS materials is typically provided for the duration of your course enrolment. We reserve the right to disable access due to legal or policy reasons, or upon termination of your enrolment.

3.6. WhatsApp Communication: We may use business WhatsApp for student support and important announcements. By creating an account and providing your phone number, you opt-in to receive relevant messages from Diginet Academy via WhatsApp.

4. Pricing, Payment, and Fees

4.1. Course Fees: Fees for each Course are listed on the Site or provided during the admission process. Fees may include registration fees, tuition fees, and potentially material costs, which will be clearly communicated.

4.2. Payment: You agree to pay all applicable fees for the Course you enroll in, according to the payment schedule provided. You authorize us (or our third-party payment processors) to charge your chosen valid payment method (e.g., debit card, credit card, bank transfer).

4.3. Payment Processors: We utilize secure third-party payment partners. We do not store your full credit card or sensitive payment details on our servers.

4.4. Invalid/Failed Payments: If your payment method fails or your account is past due, we may suspend or terminate your access to both the offline Course sessions and the LMS materials until payment is successfully processed. You agree to pay all collection costs, including reasonable attorney fees, if applicable.

4.5. Promotions: We may occasionally offer promotions or discounts. Any discounted price is applicable only for the specified period and under the specific terms of the promotion. The final applicable price is the one confirmed at the time of completing your enrolment and initial payment.

6. Intellectual Property

All content provided as part of the Courses, on the Site, and within the LMS, including text, graphics, logos, images, videos, software, and course materials, is the property of Diginet Academy or its licensors and is protected by copyright and other intellectual property laws. You may not use any Diginet Academy intellectual property without our prior written consent.

7. Disclaimers

The Site, Courses, and all related materials are provided "as is" without any warranties, express or implied. While we strive to provide high-quality training, Diginet Academy does not guarantee any specific learning outcomes, job placement, or career advancement as a result of completing a Course. Success depends on individual effort, background, and market conditions.

8. Limitation of Liability

To the fullest extent permitted by law, Diginet Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site, Courses, or LMS; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Kochi, Kerala.

10. Changes to Terms

Diginet Academy reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect, likely via email or a notice on the Site. What constitutes a material change will be determined at our sole discretion. Your continued use of the Site or participation in Courses after any changes constitutes acceptance of the new Terms.
